Obama: Google infringes on Android – Computerworld.nl

A new development in the historic lawsuit between Oracle and Google. The White House has now officially endorses the view that Oracle rallied on APIs (application programming interfaces) are copyright. This position can have enormous consequences for the entire software industry, which depends on connection and interoperability between different systems

The case revolves around Java APIs which are used by Google for Android. Infringement complained Oracle which Java has taken over the assets of Sun. APIs are just ordinary software code and thus copyrighted, and Google did not have permission and must pay. Oracle found much support from other tech companies.

Google, in turn, supported by many other parties, argues that APIs essential functionality for interoperability. It is like a book: it is the frame and not the content of the books themselves. Google had initially equal of Judge William Alsup, himself a developer. The fact only concerns the APIs headers, the command structure, and not to the underlying API code itself.

“Assigning Oracle’s claim would mean that everyone Copyright protections may get one version of code for a functional command structure and thus all others prevent you from writing their own different versions partially or entirely uses the same command structure. No one has ever supported such a far-reaching claim, “said Alsup.

However, on appeal, the tide turned completely. The appeals court gave similar Oracle. “We conclude that a set of commands to a computer instructions to perform certain operations can be an expression which copyright may deserve,” the appeals court ruled last year. A lower court would have to decide yet whether Google may still be able to call on fair use , lawful creative reuse of fragments.

Google, however, was appealed to the Supreme Court, the highest court in the US Which asked the Obama administration to include their views in the case. The White House supports now behind Oracle, the IDG News Service reports, and the Supreme Court also asks to reject Google’s appeal. In that case only the fair use question still open
